WHO IS LIABLE FOR RIDESHARE ACCIDENTS?
In order to be hired by Uber or Lyft (as well as most other major rideshare companies), drivers must have their own auto insurance. However, in most cases, drivers are not covered by their private insurance while they are driving for pay. To make up for this gap in coverage, both Uber and Lyft offer insurance coverage for drivers in “driving mode.”
The extent of this coverage varies depending on the situation. It is also important to note that, in most cases, rideshare coverage only applies after the driver’s private insurance has paid the injured individual/individuals first.
Uber and Lyft offer liability insurance coverage for drivers who are working for them at the time of an accident. Both company’s policies are very similar and work as follows:
- If the driver is in “driving mode” but does not have a passenger in the vehicle with them, coverage includes:
- Up to $50,000 for each injured person
- Up to $100,000 total injury coverage per accident
- Up to $25,000 for property damage
- If the driver is in “driving mode” and does have a passenger:
- Up to $1 million total coverage is provided
RIDESHARE ACCIDENT CASE EXAMPLES
If an Uber driver has the app switched on and is looking for a passenger (but has not yet picked someone up) and he rear-ends another driver stopped at a traffic signal, the injured driver who was rear-ended may be able to receive up to $50,000 for their injuries, as well as up to $25,000 in property damage.
If, however, a Lyft driver is transporting a passenger when she causes an accident, anyone injured in the accident, including the passenger, are eligible to recover compensation that does not exceed $1 million total.
In contrast, if an individual who occasionally drives for Uber or Lyft causes an accident while he is not in “driving mode,” anyone injured in the accident may only seek compensation through the driver’s private auto insurance provider.
